The legal framework which governs solar installations is that for "electrical energy producers under special regime", currently regulated under Royal Decree 1578/20088. R.D. 1578/088 establishes a solar feed-in tariff and sets out the operating conditions for the sector.
- The solar feed-in tariff is established, quarterly quotas are fixed for the regulation of installations, and the Registry of Advance Allocation of installations is created.
- The electricity company is required to purchase all the solar energy connected to the grid which is produced under the established procedure.
- The solar tariff is flexible and updated quarterly depending on the number of requests received by the Registry or Advance Allocation of the Ministry for Industry.
- Roof-based solar installations start from an initial level of compensation of 0.32/0.34€/kWh, applied to roofs greater than and less than 20 kW respectively.
- The economic regime for installations coming under the Royal Decree 1578/08 runs for a period of 25 years guaranteed and is not subject to the retroactive impact of subsequent legislation.
Under this legal framework, the owner of a solar installation connected to the grid becomes an electrical energy producer under special regime, bills the electricity company and makes quarterly VAT/IGIC (General Indirect Canary Islands Tax) returns.
